These Terms of use (the “Terms”) govern your access to and use of the mobile application Seekia and related services (collectively, “Seekia”, the “App” or “Service”). Please read these Terms carefully.

By downloading, accessing or using the App, you agree to be bound by these Terms. If you do not agree with them, you must not use Seekia.

Terms of use

1. On Seekia

Seekia is an assistant fashion buying and powered by image recognition and artificial intelligence. The App allows you to upload or capture images of clothes and discover similar products available through online shops of any third party.

Seekia is operated by its owner (“we”, “us” or “our”). References to “you” or “user” refer to anyone that you install, access, or use the App.

Our privacy Policy explains how we collect, use, and share your information when you use Seekia. When you use the App, you also agree to our privacy Policy, available in the App and on our web site.


 

2. Eligibility

you may Only use Seekia if:

  • you Have at least 13 years old (or the minimum age required in your country to use this type of service), and

  • you Have legal capacity to enter a binding agreement in your jurisdiction.

If you use Seekia in the name of another person or entity, you represent and warrant that you are authorized to accept these Terms on your behalf.


 

3. Account registration and security

to access certain features of Seekia, you may need to create an account.

You agree to:

  • Provide true, current and complete information during the registration.

  • Keep your login credentials secure and confidential.

  • Be responsible for all activities that occur under your account.

  • Inform us immediately, before any unauthorized use, or suspected breach of security.

We reserve the right to suspend or terminate accounts that violate these Terms.


 

4. Subscriptions and payments

Seekia offers subscription plans optional automatic renewal that unlock additional features and benefits (the “Subscription”). Available plans may include, for example:

  • Seekia Plus – Monthly

  • Seekia Plus – Annual

  • Seekia Premium – Monthly

  • Seekia Premium – Annual

the exact names of The plans, the features included and the prices are listed in the App and on the product page in the App Store, and may vary by region.


4.1. Billing and automatic renewal

subscriptions are billed via your Apple ID using the App Store of Apple.

  • The payment will be charged to your Apple account ID at the time of the confirmation of the purchase.

  • Each subscription is auto renewal and will automatically renew for the same duration (for example, monthly or annual) at the price in force at that time unless you cancel at least 24 hours before the end of the current billing period.

  • Your account will be charged for renewal within 24-hours prior to the end of the current period.

You can manage or cancel your subscription at any time from the settings of your device:

Settings → [tu nombre] → Subscriptions

Deleting the App does not cancels the subscription. You must cancel it explicitly in the settings of subscriptions in your Apple account ID to avoid future charges.


4.2. Duration of the subscription price and

Length of subscription:

  • monthly plans provide access for a month period.

  • The annual plans provide access during the twelve-month period.

Prices:
The price of each plan (and currency) will be clearly displayed in the App and on the product page in the App Store before you confirm your purchase. Prices may vary depending on your region and applicable taxes.

If we change the price of a subscription, we will notify you through the App Store, or within the App, and the new price will be applied at the next billing period, subject to the standards of Apple. If you do not agree with the price change, you must cancel your subscription before the next renewal.


4.3. Free trials and offers an introduction

to time, we may offer free trials or promotional offers on certain subscription plans.

  • The duration and terms of any test or offer shall be specified in the App or in the App Store.

  • Unless you cancel before the trial period ends, the subscription will automatically convert into a paid subscription, and the appropriate fee will be charged to your Apple account ID.

  • When permitted by law and the policies of Apple, any unused portion of a free trial period may be lost when you purchase a subscription.


4.4. Refunds

All payments and refunds are handled through Apple through the App Store.

As a general rule, paid subscription fees are non-refundable once loaded, except as required by applicable law or the refund policies of Apple.

If you believe that you are entitled to a refund, you will need to apply directly to Apple through the support of the App Store, or from the purchase history of your account Apple ID.


 

5. Use of the Service,

you Agree to use Seekia only for purposes that are legal and in accordance with these Terms. In particular, you must not:

  • Use the App in a way that violates applicable laws or regulations.

  • Upload, share or submit content that is unlawful, harmful, offensive, or violates the rights of third parties.

  • Attempt to access or interfere with accounts, servers, networks, or systems for which you do not have authorization.

  • Reverse engineer, decompile, disassemble, modify or create derivative works based on the App.

  • Use automated means (bots, scripts, scrapers, etc) to access or interact with the Service in any manner that could damage their stability or security.

We may, in our sole discretion, suspend or terminate your access to the App if we reasonably believe that you have violated these Terms.


 

6. User content

Seekia allows you to upload or capture images of garments and other related content (“user Content”).

You remain the owner of the rights to your user Content but you grant us a license a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, process, analyze, display and perform such user Content solely in order to operate, improve and deliver the Service (including training and improvement of algorithms when permitted by law and our privacy Policy).

You are responsible for ensuring that:

  • You possess the necessary rights and permissions to upload and use the Content of the user.

  • The user Content does not infringe the copyright, trademark, privacy, self-image, or other rights of third parties.

  • The user Content does not violate applicable law or these Terms.

We may remove or block access to any user Content that we reasonably consider that violates these Terms or applicable law.


 

7. Products, services, and third-party links

Seekia may not display or link to any products, content, websites, or services offered by third parties (for example, online shops where you can buy garments).

These third parties are not under our control and we are not responsible for their products, content, terms, policies or practices.

Any purchase, transaction or interaction you may have with a third party is solely between you and the third party in question.

We do not guarantee the availability, accuracy, quality, price or delivery of any product or service of any third party.

You should carefully review the terms of use and privacy policies of any third party before interacting with him.


 

8. Location services

Seekia may request access to your device’s location to provide certain functions, such as displaying content or offers relevant for your region.

You can control the permissions of location at any time from the settings of your device. If you turn off location services, some of the functions of Seekia may not work properly.

Any use of location data is governed by our privacy Policy.


 

9. Intellectual property

All rights, title and interest in and to Seekia, including the App, the software, design, text, graphics, logos, trademarks and other content (excluding user Content) are owned by us or our licensors, and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable and revocable license to use the App for your personal non-commercial use, strictly in accordance with these Terms and the rules of the App Store that may be applicable.

You may not copy, distribute, modify, publicly display, publicly perform or create derivative works based on the App or at one of their parties, unless expressly authorised by us in writing.


 

10. Disclaimers

Seekia is provided “as is” (“as is” and “as available” basis (“as available”). To the maximum extent permitted by law, we disclaim all warranties, express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

We do not warrant that:

  • The App is error-free, be safe, secure or operate without interruption.

  • The results obtained from using the App are accurate, complete, or reliable.

  • Any defects will be corrected.

Use Seekia under your own responsibility.


 

11. Limitation of liability

to the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether direct or indirect, nor for loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to, or use of, or inability to access or use, Seekia.

  • Any conduct or content of third parties on or through the App.

  • Any content obtained from the App.

  • Any unauthorized access, use or alteration of your transmissions or content.

In any event, our total liability to you for all claims arising from or related to the App or these Terms is limited to the amount you have paid us, if any, for access to the App during the twelve (12) months preceding the event that gave rise to the claim, or the minimum amount higher than that required by applicable law.

Some jurisdictions do not allow certain exclusions or limitations of liability, so it is possible that some of the above limitations may not apply in your case.


 

12. Compensation

You agree to indemnify, defend, and hold harmless us and our subsidiaries, officers, directors, employees, partners, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys ‘ fees) arising out of or related in any way to:

  • Your access to or use of Seekia.

  • Your user Content.

  • Your breach of these Terms.

  • Your violation of any third party right.


 

13. Resolution and termination

We may suspend or terminate your access to Seekia, in whole or in part, at any time and without prior notice if we reasonably believe that:

  • You have violated these Terms or applicable law, or

  • Your use of the App can cause damage to us, other users or third parties.

You can stop using the App at any time and delete it from your device. Termination will not entitle you to any refund, except as required by applicable law or the policies of Apple.

Certain provisions of these Terms which by their nature should survive termination will survive, including, without limitation, those relating to intellectual property, disclaimers, limitation of liability, indemnification and applicable law.


 

14. Changes in the Service and under these Terms

We may update Seekia, change, or terminate functions and amend these Terms from time to time.

When we make any substantial changes to these Terms, we will update the date of “Last update” at the start of this document, and we may notify you of changes within the App or by any other reasonable means.

Your continued use of Seekia once the changes have entered into force constitutes your acceptance of the updated Terms. If you do not agree with the modifications, you must stop using the App.


 

15. Applicable law and resolution of disputes

These Terms and any dispute or claim arising out of them or in connection with them or with Seekia shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of laws rules.

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
