Terms of Use (EULA)

1. About Seekia

Seekia is a fashion and shopping assistant powered by image recognition and artificial intelligence. The App allows you to upload or capture images of clothing items and discover similar products available online through third-party merchants.

Seekia is operated by its owner (“we,” “us” or “our”). References to “you” or “user” refer to any person who installs, accesses or uses the App.

Our Privacy Policy explains how we collect, use and share your information when you use Seekia. By using the App, you also accept our Privacy Policy, available in the App itself and on our website.

2. Eligibility

You may only use Seekia if you:

Are at least 13 years old (or the minimum age required in your country to use this type of service), and

Have the legal capacity to enter into a binding agreement in your jurisdiction.

If you use Seekia on behalf of another person or entity, you represent and warrant that you are authorized to accept these Terms on their behalf.

3. Account Registration and Security

To access certain Seekia features, you may need to create an account.

You agree to:

Provide truthful, current and complete information during registration.

Keep your access credentials secure and confidential.

Be responsible for all activities carried out from your account.

Notify us immediately of any unauthorized use or suspected security breach.

We reserve the right to suspend or cancel accounts that violate these Terms.

4. Subscriptions and Payments

Seekia offers optional auto-renewing subscription plans that unlock additional features and benefits (the “Subscriptions”). The available plans may include, for example:

Seekia Plus – Monthly

Seekia Plus – Annual

Seekia Premium – Monthly

Seekia Premium – Annual

The exact plan names, included features and prices are shown in the App and on the product page in the App Store, and may vary by region.

4.1. Billing and automatic renewal

Subscriptions are billed through your Apple ID account via Apple's App Store.

Payment will be charged to your Apple ID account at the time of purchase confirmation.

Each subscription is auto-renewing and will renew automatically for the same duration (for example, monthly or annual) at the then-current price, unless you cancel at least 24 hours before the end of the current billing period.

Your account will be charged for renewal within 24 hours prior to the end of the current period.

You can manage or cancel your subscription at any time from your device settings:

Settings → [your name] → Subscriptions

Deleting the App does not cancel the subscription. You must expressly cancel it in the subscription settings of your Apple ID account to avoid future charges.

4.2. Subscription duration and prices

Subscription duration:

Monthly plans provide access for one month per period.

Annual plans provide access for twelve months per period.

Prices: The price of each plan (and the currency) will be clearly displayed in the App and on the product page in the App Store before you confirm your purchase. Prices may vary depending on your region and applicable taxes.

If we change the price of a subscription, we will inform you through the App Store or within the App, and the new price will apply from the next billing period, subject to Apple's rules. If you do not agree with the price change, you must cancel your subscription before the next renewal.

4.3. Free trials and introductory offers

From time to time, we may offer free trials or promotional offers for certain subscription plans.

The duration and conditions of any trial or offer will be specified in the App or in the App Store.

Unless you cancel before the end of the trial period, the subscription will automatically convert into a paid subscription and the corresponding fee will be charged to your Apple ID account.

Where permitted by law and Apple's policies, any unused portion of a free trial period may be forfeited when you purchase a subscription.

4.4. Refunds

All payments and refunds are handled by Apple through the App Store.

As a general rule, subscription fees are non-refundable once charged, unless required by applicable law or Apple's refund policies.

If you believe you are entitled to a refund, you must request it directly from Apple through App Store support or from the purchase history of your Apple ID account.

5. Use of the Service

You agree to use Seekia only for lawful purposes and in accordance with these Terms. In particular, you must not:

Use the App in a way that violates applicable laws or regulations.

Upload, share or send content that is unlawful, harmful, offensive or that infringes the rights of third parties.

Attempt to access or interfere with accounts, servers, networks or systems for which you do not have authorization.

Reverse engineer, decompile, disassemble, modify or create derivative works based on the App.

Use automated means (bots, scripts, scrapers, etc.) to access or interact with the Service in a way that may harm its stability or security.

We may, at our sole discretion, suspend or terminate your access to the App if we reasonably believe that you have violated these Terms.

6. User Content

Seekia allows you to upload or capture images of garments and other related content (“User Content”).

You remain the owner of the rights to your User Content, but you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, process, analyze, display and perform such User Content solely for the purpose of operating, improving and providing the Service (including training and improving algorithms where permitted by law and our Privacy Policy).

You are responsible for ensuring that:

You own the rights and permissions necessary to upload and use the User Content.

The User Content does not infringe copyrights, trademarks, privacy, image rights or other rights of third parties.

The User Content does not violate applicable law or these Terms.

We may remove or block access to any User Content that we reasonably consider to violate these Terms or applicable law.

7. Third-Party Products, Services and Links

Seekia may display or link to products, content, websites or services offered by third parties (for example, online stores where you can buy garments).

These third parties are not under our control, and we are not responsible for their products, content, terms, policies or practices.

Any purchase, transaction or interaction you carry out with third parties is exclusively between you and the third party in question.

We do not guarantee the availability, accuracy, quality, price or delivery of any third-party product or service.

You should carefully review the terms and privacy policies of any third party before interacting with it.

8. Location Services

Seekia may request access to your device's location to provide certain features, such as showing content or offers relevant to your region.

You can control location permissions at any time from your device settings. If you disable location services, some Seekia features may not work properly.

Any use of location data is governed by our Privacy Policy.

9. Intellectual Property

All rights, title and interest in Seekia, including the App, the software, design, texts, graphics, logos, trademarks and any other content (excluding User Content), belong to us or our licensors, and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable and revocable license to use the App for your personal, non-commercial use, strictly in accordance with these Terms and with the applicable App Store rules.

You may not copy, distribute, modify, publicly display, publicly perform or create derivative works based on the App or any part of it, except with our express written authorization.

10. Disclaimers

Seekia is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including, among others, the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

We do not guarantee that:

The App will be error-free, secure or operate without interruption.

The results obtained from using the App will be accurate, complete or reliable.

Any defect will be corrected.

You use Seekia at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of profits or revenue, whether directly or indirectly, nor for loss of data, use, goodwill or other intangible losses resulting from:

Your access to or use of, or inability to access or use, Seekia.

Any conduct or content of third parties on or through the App.

Any content obtained from the App.

Any unauthorized access, use or alteration of your transmissions or content.

In any event, our total liability for all claims arising out of or relating to the App or these Terms will be limited to the amount you have paid us, if any, for access to the App during the twelve (12) months preceding the event giving rise to the claim, or to the higher minimum amount required by applicable law.

Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend and hold harmless us and our affiliates, officers, directors, employees, partners and agents from any claim, liability, damage, loss and expense (including reasonable attorneys' fees) arising out of or in any way related to:

Your access to or use of Seekia.

Your User Content.

Your breach of these Terms.

Your infringement of any third-party right.

13. Termination

We may suspend or terminate your access to Seekia, in whole or in part, at any time and without prior notice if we reasonably believe that:

You have violated these Terms or applicable law, or

Your use of the App may cause harm to us, to other users or to third parties.

You may stop using the App at any time and delete it from your device. Termination does not entitle you to any refund, unless required by applicable law or Apple's policies.

Certain provisions of these Terms that by their nature should survive termination will remain in force, including, without limitation, those relating to intellectual property, disclaimers, limitation of liability, indemnification and governing law.

14. Changes to the Service and to These Terms

We may update Seekia, change or discontinue features and modify these Terms from time to time.

When we make substantial changes to these Terms, we will update the “Last updated” date shown at the beginning of this document and may notify you of the changes within the App or by other reasonable means.

Your continued use of Seekia after the changes take effect constitutes your acceptance of the updated Terms. If you do not agree with the modifications, you must stop using the App.

15. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them or with Seekia will be governed by and construed in accordance with the laws of Spain, without regard to its conflict-of-law rules.

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
