2. Data We Collect

Contact data: If you choose to communicate with us through the contact form or by email, we may collect your name, email address and the message you send us. This data is used solely to reply to you and resolve your inquiries.

App usage data: When you use the Seekia app, we collect the information needed to provide the service: for example, the images you upload to search for garments, the style preferences you may set and the garments you save in your virtual closet. These images and data are processed to offer you personalized results and are stored securely so you can access your history (for example, your favorites in the virtual closet).

Technical data: The application may collect anonymous technical information, such as device type, operating system version, preferred language and general usage statistics (for example, which features are used most often). This data helps us improve Seekia's performance and fix potential problems, and it does not allow you to be personally identified.

Cookies and web browsing: Our website may use first-party and third-party cookies. In particular, when you click on product links (affiliate purchase links), a third-party tracking cookie (for example, from the affiliate network) may be installed to record where the visit came from. These affiliate cookies do not collect personal data about you; they only tell the provider that you came from Seekia for the purpose of accounting for commissions. You can configure your browser to reject cookies, although this could affect the proper functioning of some sections of the website.

• Location data: The application may access or process approximate user location data, such as country, region or city, when necessary for the operation of the service, security, abuse prevention, personalization of the experience or technical analysis of the use of the application. Seekia does not use the device's precise location to track the user in real time. If any feature requires access to precise location, the app will request the corresponding permission before accessing that information.

3. Purpose of Processing

We use your data exclusively for the following purposes:

Providing the service: Processing the images you upload and your preferences to offer you image-based clothing search results, outfit suggestions and the app's other features.

Communication: Replying to the inquiries you send us through the contact form or email, as well as informing you about important app updates (for example, changes to policies or significant improvements).

Product improvement: Analyzing the use of our application in an aggregated and anonymous way (most-used features, number of searches performed, etc.) to understand how we can improve the user experience and add new features of interest.

Security and abuse prevention: Ensuring the proper use of the platform, investigating potentially fraudulent or malicious activity to protect both users and Seekia.

We will not use your data for purposes other than those described, unless we obtain your explicit consent or are required to do so by law.

• Location and personalization: We may use approximate location data to adapt the user experience, improve service availability, apply security measures, prevent abuse, generate technical statistics or show more relevant content according to the user's country or region.

4. Legal Basis for Data Processing

We process your personal data in accordance with the legal bases established by the General Data Protection Regulation (GDPR) and applicable legislation:

For providing the service (garment search, outfit creation, etc.), the legal basis is the performance of the contract with you, that is, allowing you to use the app according to its features. Without your data (images, preferences) we could not provide the results you request.

To reply to your inquiries or communications, we rely on your implied consent when you voluntarily send us such messages.

For usage analytics that help us improve the service, we rely on Seekia's legitimate interest in optimizing the experience, making sure that your rights and freedoms are not affected in this process (the data used for this purpose is anonymous or pseudonymized).

In the case of affiliate cookies or other non-essential cookies, the legal basis is your consent, which is collected when you browse the site after being informed through the corresponding cookie notice.

5. Sharing Data with Third Parties

At Seekia we respect the confidentiality of your data and we do not sell or transfer personal information to third parties for commercial purposes. We will only share your data in the following circumstances:

Technology service providers: We use trusted third-party platforms to run Seekia. For example, Firebase (Google) acts as our database and storage provider, which means your images and data may be hosted on its secure servers. Likewise, we use the OpenAI API and Microsoft's Bing Search service to process your searches; in these cases, the necessary data (such as the image or the search terms) is sent to those services to obtain the results, but these companies do not receive information that directly identifies you (such as your name or contact details). All our providers comply with strict security and privacy standards.

Purchase and affiliate links: When you select a product suggested in Seekia, we provide you with a link that takes you to the official website of the store or brand in question so you can complete your purchase. These links may be affiliate links, so the store or the affiliate network (e.g., Awin) may record that you arrived from our app. This is normally done through cookies or URLs with special identifiers. Please note that, when you click on those links, you will be interacting directly with the external store's site, which will have its own privacy policy and cookie use. Seekia does not provide your personal data to the stores, beyond the technical information needed to trace the referral (such as that affiliate identifier).

Legal requirements: We may disclose personal information if required by law or by a competent authority, or if necessary to protect our legal rights, resolve disputes or enforce our terms of service (for example, to investigate possible fraudulent use of the app).

• Data processed by providers: Some technology providers used by Seekia, such as Firebase/Google, Microsoft Bing, OpenAI or other infrastructure, analytics, security or processing services, may process technical data, identifiers, images, queries, device information or approximate location data when necessary to provide the service, maintain security, analyze performance or improve the application.

6. Data Retention

We will only keep your personal data for as long as necessary to fulfill the purposes described. For example:

Contact data provided in an inquiry will be kept for the time needed to handle your request and a reasonable period afterwards in case of follow-up communications.

The images you upload and your saved items in the virtual closet will remain stored as long as you keep using the app and keep your account active. If you decide to delete an item from your closet or close your account, we will delete that data from our systems (please note that there may be a short delay in completely deleting the data from all of our backups).

Anonymous technical and usage data may be kept indefinitely for statistical purposes, since it does not constitute personal data.

7. Information Security

We implement technical and organizational security measures to protect your data against unauthorized access, alteration, disclosure or destruction. This includes encrypted communications with our servers, secure storage on Firebase and restricted access controls to the information by our own team. Although no system is completely invulnerable, at Seekia we strive to apply industry best practices to safeguard your information. We also recommend that you keep your app access credentials confidential (in case the app allows you to create an account) and not share your login information with third parties.

8. User Rights

In accordance with current regulations, you have the right to:

Access the personal data we hold about you, and obtain information about how it is being used.

Rectify your data if you consider it inaccurate or incomplete (for example, correcting your name or updating your email address).

Erase your data (the “right to be forgotten”), in which case we will delete the personal information we hold about you, except what we are required to keep by law or for legitimate purposes. Please note that by deleting certain data you could lose access to app features (for example, if you request the deletion of your saved images, those searches will no longer be available in your history).

Object to certain processing of your data or request its restriction, in circumstances established by law. This includes, for example, the right to object to our using your data for product improvement through analytics, or to reject non-essential tracking cookies.

Data portability: where applicable, you can ask us to receive the personal data you have provided to us in a common electronic format, in order to transfer it to another provider if you wish.

To exercise any of these rights, you can write to us at any time at help@seekia-app.com stating which right you wish to exercise and providing proof of identity to protect your privacy (for example, by sending the request from the same email address you registered with us, so that we can verify it). We will handle your request within the legal deadlines and inform you of the actions taken.

9. Children's Privacy

Seekia is not directed at children under 14. We do not knowingly collect personal information from children. If you are a parent or guardian and believe your minor child has provided us with personal data without your consent, please contact us immediately at help@seekia-app.com. We will take the necessary measures to delete that information from our systems.

10. Changes to this Policy

We may update this Privacy Policy from time to time to reflect improvements in our practices or regulatory changes. We will publish any modification on this same page, indicating the date of the last update at the beginning of the document. We recommend that you review this policy periodically to stay informed about how we protect your information. If we make a significant change, we may also notify you through the app or by email.
